This agreement shall become eective on the date of signing and shall remain eective until one year there from, subject to extension at the sole discretion of ‘GOKALDAS LIFESTYLE’

• On booking done at any of the projects of Gokaldas Lifestyle or its Group Companies the Member can avail of 2% brokerage on Consideration Value.
• First visit of Customer has to be with the Member or after written intimation via an email confirming the visit / meeting in advance. However personal visit by Member along with prospective customer will always be advisable / preferred by the Company.
• If found, that the client has already visited directly, No brokerage will be given to the Member. However in the event the client has visited 4 months prior to the date of his subsequent visit with the Member, 1% brokerage will be payable.
• Brokerage as per the Company’s policy, in respect to all the projects of the company, will be payable upon receipt of 30% of the Flat Consideration value and after execution of the Agreement for Sale, subject to receipt of due payments whichever is higher. In case the Agreement for Sale is not executed, then upon receipt of 50% of the Flat consideration subject to receipt of due payment whichever is higher.
• All payments to the Member shall be made in Indian Currency after deduction of applicable taxes. The payment shall at all times be subject to being permitted and valid under applicable policies, laws, orders, and regulations.
• The Member shall raise an invoice for the amounts payable by the Company. Each invoice shall be delivered to the address of the company, as specified by the Company, by courier or by hand delivery.
• Subject to the fulfillment of all the Conditions stated herein, the Company shall attempt to pay the brokerage within 30 days of receipt of the invoice. All payments shall be made subject to deduction of tax at source.
• If the client has made the first visit with one Member and the second visit with another Member, the brokerage will be paid to the first Member only unless and until understanding between both the Member is agreed and informed to the Company in writing.
• For any type of Transaction, the booking should take place within 6 months from the date of first visit; only under such circumstances brokerage will be paid to the Members. However in case if booking through Member is done between 6 to 12 months of his first visit, 1% brokerage will be given. If booking is done after 12 months of his first visit, no brokerage will be paid.
• In the event that the Customer cancels or terminates the Agreement of Sale / Allotment Letter / Booking to purchase the Flats / Premises the Member shall forthwith, within 15 days, refund the brokerage received from the company for the sale of the Flats / Premises. In the event that the Member does not refund the Brokerage to the Company, the Company shall be entitled to adjust / deduct the refundable brokerage from any other brokerage payable to the Member by the Company.
• Proprietary Rights: each of the Parties to the agreement acknowledges and covenants that all Proprietary and Intellectual rights of Gokaldas Liflestyle are the exclusive property of Gokaldas Lifestyle only and all information, including improvements, developed, made or conceived by Gokaldas Lifestyle, whether or not registered as a trademark or copyright, patented or patentable, shall be and remain the sole property of Gokaldas Lifestyle. The broker/ consultant shall not use any mark, logo, name of Gokaldas Lifestyle, etc. without the written approval and consent of Gokaldas Lifestyle.
• Relationship: the Parties agree that the relationship of the Broker/ Consultant with Gokaldas Lifestyle shall be that of an independent Broker/Consultant and there shall be no principal agent relationship between them. Any act committed or agreement executed by the Broker shall not bind Gokaldas Lifestyle unless ratified by Gokaldas Lifestyle in writing. The Broker/Consultant shall have no authority to bind Gokaldas Lifestyle in any manner whatsoever without prior written consent by Gokaldas Lifestyle. The Broker/ Consultant, its employees or agents shall not be considered as the employees of Gokaldas Lifestyle in any manner whatsoever.
• Member shall not pass on the brokerage or part of brokerage to the buyer without consent of Gokaldas Lifestyle or its group Companies.
• Member will not misrepresent any facts, figures, features of Gokaldas Lifestyle products / company. Member should follow high ethical standards.
• The Company shall not be responsible for any dispute between Member and client.
• This form should be duly completed with Photograph, Photo copy of the PAN Card and Business Card.
• Either party can terminate this referral agreement by giving one month’s clear notice in writing to the other party. Pursuant to termination, the Developer hereby agrees to pay any un-settled professional fees within 30 days from the date of termination.
• All disputes, dierences or question which may at any time arise between the parties hereto or any persons claiming under them, touching or arising out of or in respect of this Agreement and/or any other document or documents that may be executed pursuant thereto by and between the parties hereto shall be referred to the Arbitration in accordance with and subject to the provisions of the Arbitration and Conciliation Act, 1996, or any statutorymodification or re – enactment thereof for the time being in force. The Company shall be entitled to appoint/nominate one Arbitrator. The award of theArbitrator shall be final and binding on the parties to the reference. The arbitration proceedings shall be held in Bangalore only.
• This Agreement shall be governed by and construed in accordance with the Laws of India and subject to the jurisdiction of the Courts of Bangalore in the state of Karnataka only.

ALL MEMBERS SHOULD HAVE A MEMBERSHIP NUMBER, SERVICE TAX NUMBER AND PAN CARD NUMBER.

The Member’s Name & Id no needs to be mentioned in the Customer Booking Form

• Gokaldas Lifestyle reserves the right, in its sole discretion, to modify or suspend the Terms & Conditions of the Registration Form
• Consideration Value = Base Value + Floor Rise Charges
• In case the customer is availing of a loan and paying upto 25% as the own contribution, sanction letter is mandatory
